1. Definitions
Client: any natural person of legal age or legal entity, capable within the meaning of Articles 1123 et seq. of the Civil Code, who orders a product on the www.protectyourglass.fr website.
Product: any item offered for sale on the www.protectyourglass.fr website, in particular anti-spiking drink covers, sold in standard or personalised versions according to the specified conditions.
Seller: the company MCBH SAS, operator of the www.protectyourglass.fr website.
Order: act by which the Client agrees to purchase one or more Products offered by the Seller via the Site.
User: any internet user browsing the www.protectyourglass.fr website.
Site: e-commerce platform accessible at www.protectyourglass.fr.
2. Acceptance of Terms
Access to the Site and placing an Order imply full and unconditional acceptance of these General Terms and Conditions of Sale (GTCS), as of the date of order validation. The Seller reserves the right to modify these GTCS at any time.
3. Products
The Products offered for sale are described with the greatest possible accuracy. However, minor differences may occur. Products are available while stocks last. customisation may be offered to professionals or for orders exceeding 100 units.
4. Prices
Prices are indicated in euros, all taxes included (TTC). Delivery charges are free on orders of €10 or more. The Seller reserves the right to change its prices at any time, without notice.
5. Payment
Payment is due in full at the time of order, via credit card, Apple Pay, or PayPal. Order processing begins after payment validation. The Seller reserves the right to refuse an Order in the event of payment failure or an ongoing dispute.
6. Delivery
Deliveries are provided in mainland France and Belgium by La Poste (tracked letter). Lead times are indicative: preparation within 24 business hours and estimated delivery within 2 to 3 business days. The Seller cannot be held responsible for delays attributable to the carrier.
7. Right of Withdrawal
In accordance with Articles L221-18 et seq. of the Consumer Code, the consumer Client has a legal period of 14 days from receipt of the Products to exercise their right of withdrawal. Protect Your Glass commercially extends this period and accepts return requests for eligible Products up to 30 calendar days from receipt. Products must be new, unused, unopened, and in their original intact packaging. Any request must be sent to contact@protectyourglass.fr before returning. Return costs are borne by the Client, except in the case of a defective product or a preparation error attributable to the Seller. personalised products, gift cards, and items expressly indicated as non-refundable do not benefit from this commercial extension.
8. Retention of Title
Products ordered as part of professional purchases remain the property of MCBH SAS until full and effective payment of the price by the Client.
9. Limitation of Liability
MCBH SAS shall not be held liable in the event of assault or ingestion of substances despite the use of a drink cover. The Products offered are a supplementary preventive measure and do not guarantee absolute protection.
10. Personal Data
The collected data is necessary for order management, customer relations, and statistical purposes. The Client has the right to access, rectify, and object to their data. Any request must be made to the address contact@protectyourglass.fr. Details regarding processing are available in our privacy policy.
11. Governing Law – Jurisdiction
These GTCS are governed by French law. Any dispute relating to their application or the use of the Site shall fall under the jurisdiction of the competent courts of Rouen, unless otherwise provided by law.
At Protect Your Glass, our customers' satisfaction is a priority. If, for any reason, you are not entirely satisfied with your order, you have the right to withdraw and return the items under the conditions specified below.
Withdrawal period and commercial extension
In accordance with Article L221-18 of the French Consumer Code, you have a legal withdrawal period of 14 calendar days from the receipt of your order to exercise your right of withdrawal, without having to provide a reason or incur costs other than those provided for by law.
Beyond this legal period, Protect Your Glass grants you a commercial return extension of up to 30 calendar days from the receipt of your order, for eligible products and subject to compliance with the return conditions below. This commercial extension neither reduces nor replaces your legal rights.
Return conditions
For health and safety reasons, products must be returned unused, unopened, and in their intact original packaging.
Any product returned incomplete, damaged, soiled, or that has clearly been used will not be eligible for a refund.
Return procedure
Before returning any item, it is imperative to contact our customer service team at the following address: contact@protectyourglass.fr. We will provide you with the steps to follow as well as the return address.
Return shipping costs are the responsibility of the customer, except in the case of a defective product or an error on our part during shipping.
Refund
Once the returned product has been received and inspected, we will process the refund within a maximum of 7 business days, via the payment method used for the order.
We reserve the right to refuse any refund if the conditions mentioned above are not met.
Exchanges
We do not perform standard exchanges. If you would like a different product or a different colour, simply place a new order after receiving your refund.
Products excluded from the right of withdrawal or commercial extension
customised products, gift cards, as well as items marked as non-refundable on their product page are not eligible for the 30-day commercial return extension. Exclusions to the legal right of withdrawal are those provided for by applicable regulations.

These general terms and conditions of sale (hereinafter the “Terms and Conditions”) govern the sales of products concluded between:
MCBH SAS, a simplified joint-stock company with a share capital of €1,000, registered with the Trade and Companies Register under number 980 223 945 00018, whose registered office is located at 16 rue Alsace Lorraine, 76000 Rouen, France,
represented by Mr. Charly BOISSEE, in his capacity as legal representative,
hereinafter referred to as “Protect Your Glass” or “the Seller”,
and
Any natural or legal person making a purchase via the website www.protectyourglass.fr, hereinafter referred to as “the Customer”.
Article 1 – Purpose
The purpose of these Terms and Conditions is to define the rights and obligations of the parties in the context of the online sale of products offered by Protect Your Glass, including standardized or personalised drink cover covers.
Article 2 – Products
Protect Your Glass markets anti-spiking drink covers (anti-spiking scrunchies, silicone drink covers, fabric covers).
The products are described with the greatest possible precision on the website. However, minor variations in presentation may occur without affecting their essential characteristics.
personalisation is reserved for professional orders or large quantities (more than 100 units) and is subject to prior discussion with the Protect Your Glass team.
Article 3 – Orders
Any order placed on the website implies full and complete acceptance of these Terms and Conditions.
An order will only be considered final after receipt of full payment by the Seller.
The Seller reserves the right to refuse or cancel an order in the event of an existing dispute with the Customer, non-payment, or suspicion of fraud.
Article 4 – Prices
Prices are indicated in euros, inclusive of all taxes (TTC).
Prices are subject to change at any time. The applicable price is the one indicated at the time of order validation.
Article 5 – Payment Methods
Orders are paid for using the following methods:
Credit card (Visa, Mastercard, etc.)
Apple Pay
PayPal
Payment is due in full at the time of ordering. All transactions are secure.
Article 6 – Delivery
Products are delivered to Metropolitan France and Belgium only, via La Poste (tracked letter).
Order preparation: within 24 business hours
Indicative delivery time: 2 to 3 business days (to be checked in the cart according to updated conditions)
Delivery costs: free for orders over €10
The tracking number is sent to the Customer by email.
Article 7 – Right of Withdrawal and Returns
In accordance with Articles L221-18 et seq. of the Consumer Code, the consumer Customer has a legal period of 14 days from receipt of the products to exercise their right of withdrawal. In addition, Protect Your Glass grants an extended commercial return policy for eligible products, allowing for a return request to be made up to 30 calendar days from receipt.
Products must be returned in their original packaging, unused and unopened, to the address indicated by our customer service.
Return shipping costs are the responsibility of the Customer, except in the case of a defective product or a preparation error attributable to the Seller.
The 30-day extended commercial return policy does not apply to personalised products, gift cards, or items expressly indicated as non-refundable on their product page. Exclusions to the legal right of withdrawal remain those provided for by applicable regulations.
No refund will be issued for a product that is used, damaged, or returned without prior approval.
To exercise this right or request a return under the extended commercial policy, the Customer must contact contact@protectyourglass.fr.
Article 8 – Retention of Title
Products delivered as part of professional orders remain the property of MCBH SAS until full and effective payment of the price.
Article 9 – Liability
Protect Your Glass strives to ensure the safety of its products. However, the Seller cannot be held liable in the event of ingestion of illicit substances, assault, or incident occurring despite the use of a drink cover, particularly in the context of attempted spiking.
The Customer is informed that these products constitute an additional preventive measure, but do not guarantee absolute protection.
Article 10 – Personal Data
Collected data is used solely for order processing, customer relations, and, where applicable, commercial purposes if the Customer consents.
In accordance with the Data Protection Act (Informatique et Libertés) and the GDPR, the Customer has the right to access, modify, and delete their data. They may make a request to this effect at contact@protectyourglass.fr.
Article 11 – Disputes and Applicable Law
These Terms and Conditions are subject to French law.
In the event of a complaint that cannot be resolved amicably, the Customer may have recourse to consumer mediation or refer the matter to the competent courts.
In the event of a dispute, the competent court is the court of Rouen.
Les présentes conditions générales de location complètent les conditions générales de vente de Protect Your Glass pour toute mise à disposition temporaire de protections de verre dans le cadre d’un événement.
Article 12.1 – Objet
Protect Your Glass met à disposition du locataire, pour la durée d’un événement déterminé, un lot de protections de verre dont elle conserve la propriété. La présente location n’emporte aucun transfert de propriété, sous réserve des dispositions de l’article 12.6.
Article 12.2 – Commande et paiement
La commande est formée par l’acceptation du devis. Le montant de la location est exigible avant expédition. Aucune expédition n’est réalisée avant encaissement. Pour une première commande, Protect Your Glass se réserve le droit de limiter la quantité louée.
Toute modification de quantité après acceptation du devis entraîne un recalcul du tarif selon la grille en vigueur.
Article 12.3 – Livraison
La livraison est effectuée par Colissimo à l’adresse indiquée par le locataire. Les délais annoncés par le transporteur sont indicatifs. En cas de retard de livraison, la responsabilité de Protect Your Glass est limitée au remboursement du montant de la location, à l’exclusion de tout dommage et intérêt au titre du préjudice événementiel.
Le locataire dispose de 48 heures à compter de la réception pour émettre toute réserve sur la quantité ou l’état des produits reçus. Passé ce délai, la quantité annoncée au devis est réputée conforme.
Article 12.4 – Utilisation
Le locataire s’engage à utiliser les protections conformément à leur destination et à ne pas les modifier, marquer ou personnaliser. Le lot loué porte l’identité Protect Your Glass ; la personnalisation aux couleurs du locataire est réservée à la vente.
Article 12.5 – Restitution
Les protections sont restituées par dépôt en Point Relais au moyen de l’étiquette prépayée jointe au colis aller, dans un délai de 5 jours ouvrés à compter de la date de l’événement.
À compter du 16e jour suivant l’événement, les unités non parvenues sont réputées définitivement non restituées et facturées conformément à l’article 12.6.
En cas de perte du colis retour par le transporteur, le locataire communique la preuve de dépôt dans le délai imparti. À défaut, les unités concernées sont réputées non restituées.
Article 12.6 – Unités non restituées ou détériorées
Toute unité non restituée, ou restituée tachée, déchirée, souillée ou détériorée au point de ne pouvoir être remise en location, est réputée vendue au locataire au prix indiqué au devis. La propriété de l’unité est alors transférée au locataire à la date de facturation.
Le comptage est réalisé dans les locaux de Protect Your Glass dans les 48 heures suivant la réception du colis retour. Il fait l’objet de photographies horodatées communicables au locataire sur demande. Tout écart entre la quantité expédiée et la quantité restituée est à la charge du locataire.
Article 12.7 – Consigne auprès des participants
Le locataire est libre de mettre en place, auprès des participants à son événement, un système de consigne dont il fixe seul le montant. Cette consigne relève exclusivement de la relation entre le locataire et ses participants, ainsi que de sa propre comptabilité. Protect Your Glass n’en est ni bénéficiaire ni garante, et les montants recommandés au devis le sont à titre purement indicatif.
Article 12.8 – Nature du produit et responsabilité
Les protections de verre constituent un dispositif de prévention et de dissuasion. Elles ne se substituent pas à la vigilance des personnes et ne garantissent pas l’absence d’introduction de substance dans une boisson.
Protect Your Glass est tenue d’une obligation de moyens et ne saurait garantir l’efficacité des protections lorsque celles-ci ne sont pas utilisées conformément à leur mode d’emploi. Sa responsabilité ne peut en aucun cas être engagée à raison d’un dommage subi par un participant à l’événement du locataire.
Il appartient au locataire d’informer les participants des conditions d’utilisation des protections.
Article 12.9 – Facturation et retard de paiement
La facture de régularisation est émise après comptage. Elle est payable à 30 jours à compter de sa date d’émission.
Tout retard de paiement entraîne l’application de pénalités calculées au taux d’intérêt légal majoré, ainsi que, pour les locataires professionnels, l’indemnité forfaitaire de recouvrement de 40 euros prévue à l’article L. 441-10 du code de commerce.
Article 12.10 – Droit de rétractation
Lorsque le locataire agit à des fins non professionnelles, il dispose d’un délai de rétractation de quatorze jours à compter de la conclusion du contrat. Lorsque l’événement se tient avant l’expiration de ce délai, le locataire demande expressément l’exécution anticipée de la prestation et reconnaît perdre son droit de rétractation une fois la prestation pleinement exécutée.
Article 12.11 – Données personnelles
Les données collectées lors de l’acceptation du devis, à savoir les nom, prénom, qualité, adresse électronique, adresse de livraison, données d’acceptation, horodatage et adresse IP, sont traitées aux seules fins de la formation et de l’exécution du contrat, ainsi que de la conservation de la preuve de son acceptation. Elles sont conservées pendant la durée de prescription applicable et ne font l’objet d’aucune cession. Le locataire dispose d’un droit d’accès, de rectification, d’effacement et d’opposition, exerçable à l’adresse contact@protectyourglass.fr.
Article 12.12 – Force majeure
Aucune des parties ne peut être tenue responsable d’un manquement résultant d’un cas de force majeure au sens de l’article 1218 du code civil.
Article 12.13 – Droit applicable et juridiction
Les présentes sont soumises au droit français. À défaut de résolution amiable, tout litige relève de la compétence des tribunaux du ressort du siège de Protect Your Glass, sauf disposition légale impérative contraire lorsque le locataire est un consommateur.
